Terms of Usage.

These terms govern your access to and use of PulseTrace — the website, the application and the API. Please read them; by creating an account or using the service you agree to them.

Plain-language summary: use PulseTrace only to monitor things you're allowed to monitor, keep your account secure, and understand that monitoring is a tool — it helps you catch problems, but it isn't a guarantee of uptime. The full terms are below.
Agreement

1. Acceptance of these terms

By registering for an account, clicking to accept, or otherwise accessing or using PulseTrace (the "Service"), you agree to be bound by these Terms of Usage (the "Terms"). Creating an account constitutes your acceptance of these Terms. If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

If you do not agree to these Terms, do not create an account or use the Service.

The service

2. What PulseTrace provides

PulseTrace is an external monitoring and change-intelligence platform. It checks endpoints, certificates, DNS and domains, and API workflows from a fleet of probes, records the results, detects change and anomalies, and generates alerts and reports. Specific capabilities, limits and features depend on your plan and may change over time as the Service evolves.

Your account

3. Accounts and eligibility

You must provide accurate, current information when you register and keep it up to date. You are responsible for safeguarding your credentials and API keys, for all activity that occurs under your account, and for the acts and omissions of anyone you invite into your organization. Notify us promptly if you believe your account has been compromised. You must be able to form a binding contract to use the Service.

4. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. In particular, you agree that you will not:

  • Monitor, probe or test any target you do not own or are not authorized to monitor.
  • Use the Service to attack, overload, disrupt or gain unauthorized access to any system, network or third party.
  • Configure checks at a frequency or in a manner intended to cause harm to a third-party service, or that violates a third party's terms.
  • Attempt to circumvent plan limits, rate limits or access controls, or share access in a way designed to evade them.
  • Reverse engineer, resell, sublicense or provide the Service to third parties except as expressly permitted.
  • Upload or transmit unlawful, infringing or malicious content, or use the Service to violate any applicable law or regulation.

You are solely responsible for the targets you choose to monitor and for having the right to monitor them.

Plans & billing

5. Plans, trials and billing

The Service is offered in several plans, including a free tier and paid tiers. Plan limits and features are described on the pricing page and enforced by the Service. Paid plans may include a trial period; unless stated otherwise, paid subscriptions renew for successive periods until cancelled. You authorize us to charge the applicable fees to your payment method for each period. Fees are exclusive of taxes unless stated. You can change or cancel your plan at any time; changes take effect according to your billing cycle, and downgrades apply the lower plan's limits and retention going forward. Except where required by law, fees already paid are non-refundable.

Your data

6. Your data and privacy

As between you and PulseTrace, you retain all rights to the data you submit and to the monitoring results generated for your account ("Your Data"). You grant us the rights necessary to host, process and display Your Data solely to operate and provide the Service to you. We retain Your Data for the retention window of your plan, after which it is rotated out automatically. We handle Your Data in accordance with our privacy practices; Enterprise plans may enter into a separate Data Processing Agreement.

Availability

7. Availability and changes

We work to keep the Service available and reliable, but except for any uptime commitment made in a separate written agreement, the Service is provided on an "as available" basis. We may add, change, deprecate or remove features, and we may perform maintenance that temporarily affects availability. We will make reasonable efforts to communicate material changes.

Ownership

8. Intellectual property

The Service — including its software, design, and content we provide — is owned by PulseTrace and its licensors and is protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with them. All rights not expressly granted are reserved. You keep ownership of Your Data as described above.

Disclaimers

9. Disclaimers and limitation of liability

The Service is a monitoring tool. It is designed to help you detect problems, but it does not guarantee that you will be notified of every issue, and it is not a substitute for your own operational safeguards. To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

To the maximum extent permitted by law, PulseTrace will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to your use of (or inability to use) the Service — including any downtime, outage or incident you experience that the Service did not detect or report. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.

Termination

10. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if your use poses a risk to the Service or to others. On termination, your right to use the Service ends; Your Data is handled according to your plan's retention and our data-deletion practices. Provisions that by their nature should survive termination — including ownership, disclaimers, limitations of liability and governing law — will survive.

Changes & law

11. Changes to these terms, and governing law

We may update these Terms from time to time. When we make material changes, we will update the "last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. These Terms are governed by the laws of [your governing jurisdiction], without regard to conflict-of-laws rules.
